Terms of Service for Finity Frames

These Terms of Service (“Terms”) govern your access to and use of the Finity Frames website (the “Website”), operated by Agency Fish Pty Ltd trading as Finity Frames (ABN 67 120 388 794, ACN 120 388 794), an Australian Private Company located at WA 6055, Australia (“we,” “us,” or “our”). By accessing or using the Website, including browsing, purchasing products, or creating an account, you agree to be bound by these Terms. If you do not agree, you must not use the Website.

  1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Website. By using the Website, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.

  1. Products and Services

We offer display systems for collectors, including frames, and related accessories (“Products”). All Products are sold globally, subject to availability and compliance with applicable laws. Product descriptions, images, and prices are provided for informational purposes and may be updated without notice. We reserve the right to limit quantities, refuse orders, or discontinue Products at any time.

  1. Orders and Payment
  • Placing Orders: Orders are placed through the Website and are subject to acceptance by us. We may cancel or modify orders due to pricing errors, stock issues, or suspected fraud.
  • Pricing and Taxes: Prices are in the currency displayed on the Website and exclude shipping, duties, and taxes unless stated otherwise. You are responsible for all applicable taxes, customs duties, and fees imposed by your jurisdiction.
  • Payment: We accept payments via approved methods (e.g., credit cards, PayPal). Payment is due at the time of order. All transactions are processed securely through third-party providers; we do not store your payment details.
  • Order Confirmation: You will receive an email confirmation upon order acceptance. Title to Products passes to you upon full payment and shipment.
  1. Shipping and Delivery
  • We ship Products globally from our facilities in Australia. Shipping times and costs are estimated at checkout and may vary based on location, carrier, and external factors (e.g., customs delays).
  • Risk of loss transfers to you upon delivery to the carrier. We are not liable for delays, losses, or damages during transit unless caused by our negligence.
  • International shipments may incur customs fees, which are your responsibility. We comply with export laws but cannot guarantee delivery in restricted jurisdictions.
  1. Returns, Refunds, and Warranties
  • Returns Policy: You may return unused Products in original packaging within 30 days of receipt for a refund or exchange, subject to inspection. Return shipping costs are your responsibility unless the Product is defective.
  • Refunds: Refunds are processed to the original payment method within 14 days of receiving the returned Product. We do not refund shipping fees.
  • Warranties: Products are warranted against manufacturing defects for 12 months from purchase. This does not cover misuse, accidents, or normal wear. To claim, contact us with proof of purchase. Remedies are limited to repair, replacement, or refund at our discretion.
  • Exclusions: Custom or personalized Products are non-returnable unless defective.
